A legal disclaimer

Mission reminder. Part Of The Solution Nonprofit Inc. (“POTS”) offers free services focused on hope, healing, and community through resources, education, and compassionate support for individuals and families affected by addiction and mental illness.

Not medical, clinical, or legal advice. Information and services provided by POTS—including referrals, education, peer support, and resource navigation—are intended for informational purposes only and should not be used as a substitute for professional diagnosis, treatment, counseling, medical care, or legal advice. POTS does not practice medicine, psychiatry, psychology, therapy, or law; does not prescribe medications; and does not provide detox, inpatient/outpatient treatment, or emergency services.

No provider–patient relationship. Use of POTS services does not create a provider–patient, therapist–client, or attorney–client relationship with POTS or its volunteers/staff.

Referrals and third-party services. POTS may share information about community resources, treatment providers, sober living homes, funding programs, and support groups. Inclusion does not equal endorsement, and POTS makes no warranties about availability, safety, quality, cost, eligibility, insurance coverage, outcomes, or results. You are responsible for evaluating and contracting with any third party.

No guarantees of placement or funding. While we strive to help identify free/low-cost options and possible financial assistance, POTS cannot guarantee admission, approval, coverage, or any particular outcome.

Accuracy and changes. Resource information can change without notice. POTS does not guarantee that listings, schedules, eligibility criteria, or contact details are current, complete, or error-free. We may modify services, materials, and this disclaimer at any time.

Privacy notice (not HIPAA). POTS is generally not a HIPAA-covered entity. We take reasonable measures to safeguard personal information, but communications (including email, text, or web forms) may not be secure. Please share only what is necessary. POTS may be legally required to disclose information to protect someone from imminent harm or to comply with law enforcement or mandatory-reporting laws.

 

Voluntary participation & assumption of risk. Participation in any POTS activity, event, or referral is voluntary and at your own risk. To the fullest extent permitted by law, POTS, its officers, employees, and volunteers are not liable for any damages, losses, or injuries arising from the use of our information, services, or third-party resources.

Crisis and emergencies. POTS is not a crisis hotline. If you or someone you know is in immediate danger or experiencing a medical or mental-health emergency, call 911 or go to the nearest emergency room. In the U.S., you can also call or text 988 for the Suicide & Crisis Lifeline.

Eligibility & minors. Certain services may have age, residency, or other eligibility requirements. Minors should involve a parent/guardian as appropriate and as required by law.

Your consent. By using POTS services, attending events, or relying on our materials, you acknowledge and agree to this disclaimer and to our policies as updated from time to time.

These Terms and Conditions (“T&C”) are a legally binding agreement between you (“you,” “user,” or “site visitor”) and Part Of The Solution Nonprofit Inc. (“POTS,” “we,” “us,” or “our”) governing your access to and use of our websites, pages, and online services that link to these T&C (collectively, the “Site”). By accessing or using the Site, you agree to these T&C. If you do not agree, do not use the Site.

1) Who We Are & What We Offer

POTS is a nonprofit organization providing resources, education, referrals, and compassionate support around addiction and mental health. The Site may include informational content, event listings, referral directories, volunteer/donation tools, forms, and contact options. We do not sell products or provide clinical care via the Site.

2) Not Medical, Clinical, or Legal Advice

Content on the Site is for informational purposes only and is not medical, mental-health, or legal advice. Using the Site does not create a provider–patient, therapist–client, or attorney–client relationship. Always seek professional advice for diagnosis, treatment, or legal matters. In emergencies, call 911 or the 988 Suicide & Crisis Lifeline in the U.S.

 

3) Eligibility & Accounts

You must be at least 13 years old (or the age required by your jurisdiction) to use the Site. If you create an account, you are responsible for safeguarding login credentials and for all activities under your account.

 

4) Acceptable Use

You agree not to:

  • violate laws or third-party rights;

  • upload or transmit harmful code, spam, or automated scraping;

  • attempt to gain unauthorized access to the Site or related systems;

  • misuse contact forms or directories (e.g., harassment, promotion of illegal substances).
    We may suspend or terminate access for violations.

 

5) Referrals, Listings & Third-Party Services

The Site may reference or link to treatment providers, sober living homes, meetings, funding programs, grants, insurers, hotlines, or other third-party resources (collectively, “Third Parties”). We do not control, endorse, or guarantee Third Parties and are not responsible for their practices, availability, pricing, eligibility, or outcomes. Your dealings with any Third Party are solely between you and that party.

 

6) Donations & Events

Donations, if accepted online, are processed by third-party payment platforms subject to their terms and fees. Event details (dates, times, venues) may change; please verify before attending. We may set or change event participation guidelines at any time.

 

7) Intellectual Property

Unless stated otherwise, the Site (including text, graphics, logos, and other content) is owned by POTS or its licensors and protected by law. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, noncommercial purposes. Do not copy, modify, distribute, or create derivative works without written permission.

 

8) User Submissions & Feedback

If you submit content (e.g., comments, suggestions, testimonials), you grant POTS a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, display, and create derivative works from that content for our mission and operations, subject to our Privacy Notice. You represent you have the rights to grant this license and that your content does not infringe others’ rights.

 

9) Privacy & Cookies

Our collection and use of personal information is described in our Privacy Notice, which is incorporated by reference. The Site may use cookies or similar technologies to function and improve your experience; your browser settings may allow you to manage cookies.

 

10) Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, POTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND VOLUNTEERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, RELIABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

 

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR THIRD-PARTY SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO US FOR THE APPLICABLE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

 

12) Indemnification

You agree to defend, indemnify, and hold harmless POTS from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your content or submissions; (c) your violation of these T&C; or (d) your interactions with any Third Party.

 

13) Changes to the Site or These T&C

We may modify the Site and these T&C at any time. Changes are effective when posted to the Site with an updated “Last updated” date. Your continued use of the Site after changes means you accept them.

 

14) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violations of these T&C. Sections that by their nature should survive (e.g., IP, disclaimers, limitation of liability, indemnification, governing law) will survive termination.

 

15) Governing Law; Dispute Resolution

These T&C are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of state or federal courts located in Paulding County, Georgia (or the nearest competent court) for disputes not subject to arbitration.
Optional arbitration clause (use if desired; remove if not): Any dispute arising from these T&C or the Site shall be resolved by binding arbitration administered by a recognized provider, on an individual basis, and not as a class action. Judgment on the award may be entered in any court of competent jurisdiction.

 

16) Geographic Restrictions

The Site is controlled from the United States and may not be appropriate or available in other jurisdictions. You are responsible for compliance with local laws.

 

17) Accessibility

We strive to make our Site accessible. If you experience barriers, please contact us so we can help.

 

18) SMS/Email Communications

If you opt in to receive texts or emails, you consent to receive communications from us. Message and data rates may apply. You can opt out at any time as described in our messages.

 

19) Copyright/DMCA

If you believe your copyrighted work has been used on the Site in a way that constitutes infringement, please contact us with: (1) your contact info; (2) a description of the work; (3) the URL/location of the material; (4) a statement of good-faith belief; (5) a statement under penalty of perjury that your notice is accurate and you are authorized; and (6) your signature.


20) Entire Agreement

These T&C (plus any referenced policies, including our Privacy Notice and Legal Disclaimer) constitute the entire agreement between you and POTS regarding the Site and supersede prior or contemporaneous agreements on this subject.
